17-10-2018: Biodegradable Use, not made by YWP

The announcement regarding plastic straws will be banned in the FT of Kuala Lumpur, Putrajaya and Labuan from Jan 1, 2019 was not made by Yayasan Wilayah Persekutuan (YWP).

Plastic straw ban is a necessitation act by Kementerian Wilayah Persekutuan (KWP) and inline with the restriction of using hydrocarbon-based conventional plastic products in the Federal Territories of Kuala Lumpur, Putrajaya and Labuan. This enforcement act is part of promoting the initiative of using biodegradable products which was introduced in 2016 but started its implementation on Sept 1, 2017.

KWP also include the ban of the conventional plastic straws as a requirement in the business licences issued by local authorities in Wilayah Persekutuan namely Dewan Bandaraya Kuala Lumpur, Perbadanan Putrajaya and Perbadanan Labuan.

This ban will be effective on Jan 1, 2019 and full enforcement of it would only commence from Jan 1, 2020.

Thus, this line of jurisdiction shows that YWP, being a welfare arm to the people of Wilayah Persekutuan, 1) does not have any authority nor right, to announce such instructions related to the ban of use plastic straws; and 2) YWP also does not have authority to terminate any business licences if non-compliance of the ruling occurs.
